Formerly a medium-security women’s prison on W. 20th Street in Manhattan, Bayview Correctional Facility stands as a grim reminder of four decades of widespread sexual abuse that occurred during its operation.
In 2004, a former inmate filed a lawsuit against Bayview, alleging repeated sexual abuse and rape by a corrections officer, resulting in a pregnancy during her incarceration. The case was settled for $360,000, and the officer later pled guilty to 3rd-degree rape. This marked the first publicized case shedding light on the severe misconduct within the facility, leading to many more similar reports.
A 2010 federal survey revealed that Bayview had the highest reported rates of sexual abuse by staff among women’s prisons nationwide, with at least 12% of inmates between 2008 and 2009 reporting incidents of sexual abuse—five times higher than the national average of 2.2%.
Bayview Correctional Facility was permanently closed in 2012 due to damage from Hurricane Sandy. While allegations of abuse were long-standing, it wasn’t until the passing of the New York Adult Survivors Act on May 24, 2022, that hundreds of women came forward with claims of sexual misconduct by corrections officers and staff. This law provides a one-year window for adult survivors of sexual abuse to file claims against abusers, employers, and institutions for negligent acts that enabled the abuse.
The Bureau of Justice defines all forms of sexual contact with a prisoner, whether consensual or non-consensual, as sexual abuse. The New York Adult Survivors Act offers survivors of sexual abuse at Bayview Correctional Facility an opportunity to seek justice and compensation for the crimes committed against them. Claims can be filed between November 24, 2022, and November 24, 2023. It is crucial to file a claim before the deadline to hold all responsible parties accountable.
